What the AUP Template Actually Covers

The section is specific. It doesn't say "don't put sensitive data in the cloud." It says "don't put X, Y, or Z in these tools," and it names the tools.

Section 3: Client-Facing Communication. Because the biggest exposure for most small manufacturers comes through communication with clients, the policy has a specific section on this. Before using AI to draft any email to a client, the employee must: remove all specific dollar amounts, account numbers, or proprietary information before the draft stage; review the AI output for accuracy and tone; put the employee's name on the email and take responsibility for its content. This prevents the hollow, aggressively-cheerful emails that erode client trust. It maintains accountability.

Section 4: When You're Not Sure. The policy names one person—a manager, the owner, the operations lead—who employees can ask before using a tool or putting data somewhere. It's a simple escalation path. Employee is not sure. Employee asks. Decision gets made. No guessing.

Section 5: Consequences and Acknowledgment. A violation of the policy is a performance issue, subject to normal disciplinary action. First violation is a conversation. Repeat violations escalate. The policy is not a criminal statute. It's a workplace rule with normal enforcement. The acknowledgment block at the bottom is the critical part: every employee signs it and dates it, confirming they received the policy and understand it.

Why That Last Part Matters

Documented policy with employee acknowledgment is the thing that changes the liability picture when something goes wrong.

If you don't have a policy, and an employee emails client financial data to ChatGPT, and the client finds out, the conversation with your lawyer will include the phrase "we didn't have a policy." That's not a good legal position. It implies negligence. It implies you knew this could happen and didn't put guardrails in place.

If you have a policy, and an employee violates it, and something goes wrong, the conversation is different. You can show the policy. You can show the signature. You can show the training. You demonstrated due diligence. You took this seriously. You told the employee what the rules were and they violated them. That's a much stronger position.

The signature block is the difference between "we didn't know" and "we knew, we trained for it, and this employee chose to ignore it anyway." It matters.
